Workers' Compensation claims can be complex and confusing, particularly when you are seriously injured and facing the uncertainty of mounting bills and lack of income. We can assist you in getting through this difficult time.
Workers' Compensation benefits fall into four basic categories. First, if you are injured at work and in need of medical care, you are entitled to all reasonable medical care necessitated by the injury. This includes doctor visits, hospitalization, medication, physical therapy, medical devices, and related medical needs. And?.. you are entitled to select your own physician. You should not have to pay for any medical care.
Second, while recovering, if you are totally disabled because of the injury and you are under medical care, you are entitled to Temporary Total Disability benefits in an amount equal to 2/3 of your average weekly wage, but not more than a certain maximum established by law. These benefits are paid weekly or every two weeks until it is determined that you have reached your maximum medical improvement.
A sub category of Temporary Total Disability is Temporary Partial Disability, and this is available when you can return to work, but on light duty, either in the hours worked or the job classification. If you earn less while on light duty you are entitled to benefits equal to ½ the difference between what you are earning on light duty and what you would be earning if you were back full time or in your regular position.
Third, when you have reached the point of maximum medical improvement, you may be entitled to additional compensation for permanent impairment. This stage of the proceedings usually requires a hearing before the Workers' Compensation Commission and the presentation of your claim for benefits. We will work to assure that you receive every bit of compensation you are entitled to.
Fourth, if you are unable to return to your previous employment because of the injury, you are entitled to Vocational Rehabilitation Benefits. These services may consist of vocational evaluation, job placement, or when necessary, job training. While receiving vocational services you are entitled to benefits on a weekly basis as if you were temporarily totally disabled.
In summary, each of these four benefits is available to you under the Maryland Workers' Compensation Law. However, you have certain obligations that you must fulfill in order to secure your entitlement to these benefits. Fees? Attorney's fees are controlled by the Workers' Compensation Commission and are based on the amount and type of monetary compensation that your attorney obtains for you. The fees are usually paid at the end of the case, from the benefits you receive, so if there is no recovery, there is no fee.
